Residence card for an EU citizen's spouse
Where an EU citizen exercises free movement rights in Bulgaria, their non-EU spouse and certain family members have the right to accompany or join them. That right comes from EU free movement law, not from national discretion, and the document issued is not an ordinary residence permit. It is a residence card of a family member of an EU citizen, with its own legal character.

The card records a right, it does not create one
The distinction that matters most: the card does not grant you the right to stay, it evidences a right you already have. The basis is your EU-citizen relative actually exercising free movement. So a delay in printing the card does not remove the right, while the departure of the EU citizen can undermine the basis even though the plastic remains in your wallet. Treat the card as proof of entitlement rather than as an identity document.
Who counts as a family member
- The spouse, and a registered partner where such partnerships are recognised.
- Direct descendants of the EU citizen or the spouse — children, with different conditions according to age and dependency.
- Direct ascendants of the EU citizen or the spouse — parents and grandparents, as a rule where dependency is established.
- The directive's broader category of other family members: those requiring personal care on serious health grounds, or who lived in the EU citizen's household in the country of origin. Entry is not automatic here, but the authority owes a duty to facilitate and to give a reasoned decision.

How the application works in practice
Settle the EU citizen's registration first

Separation, divorce and death
EU law recognises the vulnerability created when a status depends entirely on another person, and provides for retention of the right of residence in defined situations: death of the EU citizen, departure from the country, divorce or the end of a partnership. Retention is not automatic and comes with conditions, and separate provision exists for situations such as domestic violence. If this is your situation, consult an immigration lawyer promptly, because rights are most often lost through delay rather than through refusal.
Moving to permanent status
After a defined period of continuous residence, a family member can acquire a right of permanent residence. My spouse is an EU citizen and I am not. Do I still need a visa?
Visa requirements depend on your nationality, but travelling as the family member of an EU citizen brings the facilitations of free movement law. Confirm with the Ministry of Foreign Affairs and the relevant mission before travelling.
Can I work before the card is issued?
The right exists independently of the card, which merely evidences it. Employers will nonetheless ask for documentation, so keep the receipts and filings from your application.
What if the EU citizen leaves Bulgaria?
The basis of the right is affected even though the card physically remains with you. Retention is provided for in defined cases; seek advice quickly rather than waiting for expiry.
Does each child need a separate application?
Yes. A separate file is opened for every family member with its own proof of relationship, and the evidence differs according to age and dependency.
