Permanent residence for EU citizens in Bulgaria

After a defined period of continuous lawful residence, EU, EEA and Swiss citizens acquire a right of permanent residence that no longer depends on conditions. Directive 2004/38/EC sets that threshold at five years of continuous lawful residence. From that point, employment, study or sufficient resources are no longer periodically verified.

What the status means

Permanent residence means the right stops being conditional. Income, insurance and employment are no longer checked periodically, and treatment moves closer to that of nationals. It is not citizenship — differences remain in electoral rights and access to certain public posts — but the administrative stability it brings is substantial.

When the period counts as continuous

  • Short absences from the country do not generally break continuity; the directive tolerates defined absences.
  • Special rules exist for military service, pregnancy and childbirth, serious illness and vocational training.
  • Long absences of a settled nature can break the period, and that assessment is made case by case.
  • Lawfulness is essential: undocumented periods create real difficulties of proof.

Obtaining the document

  1. Document your residence history

    Certificates, employment and insurance records, address registration and school records should form one consistent timeline.
  2. Apply to the Migration Directorate

    The application goes through the structures of the Ministry of Interior; procedure and forms are published in the service description.
  3. Close the gaps

    Where records are missing, the authority may request further evidence; bank, health and tax records help.
  4. Keep and renew the document

    The document itself may be issued for a fixed term even though the right is open-ended.

How the status is lost

Permanent residence can lapse after a prolonged and settled absence from the country. The directive sets the framework and national practice gives it concrete form. If you plan a long spell abroad, ask the Migration Directorate what your status will be on return before you go — far cheaper than starting the clock again.

The five-year rule comes from the directive and has exceptions
