Buying property in Bulgaria: process and checks
Ownership of Bulgarian real estate passes by a notarial deed, which is then entered in the property register. Paying before those two steps are complete is the single largest risk in the transaction, whatever a preliminary contract says. The safe order is: checks first, deed second, payment tied to both.

What to verify before committing
- Title and encumbrances: a search in the property register for the registered owner, mortgages, attachments, rights in rem and pending claims.
- Cadastral identity: identifier, area and boundaries as recorded by the cadastre agency; a mismatch with the listing is the first warning sign.
- Use permit: for new buildings, which construction stage has been certified and whether the permit for use exists.
- Common parts and land share: how the deed describes common parts and the share of land or building right.
- Outstanding charges: property tax, waste fee and any debts to the building's owners' association.
- Possession: if third parties occupy the property, the deed should say who must vacate it and by when.

Which cost items arise
Beyond the price there is a local acquisition tax, the notary's fee, the registration fee, an agency commission where an agent is involved, and legal fees. A mortgage adds a valuation and the cost of creating the security. No figures are given here on purpose: acquisition tax is set by each municipality, notarial fees follow a tariff, and amounts were restated with the euro changeover. Confirm current values with the municipality where the property is located and with the Registry Agency.
Where a foreign buyer's position differs
Buying buildings and apartments is generally not restricted by nationality. The distinction arises with land: acquiring plots, and agricultural land in particular, follows separate rules that apply differently to EU nationals and third-country nationals. For an apartment the question usually surfaces through the share of land attached to the unit; for a house or a plot, the structure of the transaction should be settled with a lawyer before any deposit.

Does buying property give me residence rights?
No. Ownership and residence are separate legal questions, and a residence application is assessed on its own grounds regardless of what you own.
Is a lawyer required to buy?
The notary is required; a lawyer is not. In practice the lawyer is the party checking encumbrances and contract terms in the buyer's interest, which the notarial procedure does not replace.
What if the seller refuses to appear before the notary?
Where a valid preliminary contract exists, the law provides a court route to have it declared final. The outcome depends heavily on how that contract was drafted, which is why the wording matters from the start.
