Avoiding property fraud in Bulgaria
Most property fraud is not an elaborate scheme but a timing game: the buyer pays before the register searches are done and before the notarial deed exists. Getting that single sequence right neutralises the majority of known patterns.

Patterns that recur
- A seller who is not the owner, acting on a forged power of attorney or exceeding a genuine one.
- Concealed encumbrances: a mortgaged or attached property presented as clean using an outdated certificate.
- Double sale: the same property sold twice in quick succession, with the first to register protected.
- Deposit traps: an attractive price, a deposit taken, then silence or withdrawal clauses that make refunds impossible.
- Remote rental scams: deposit and advance rent demanded for a property never viewed, advertised with someone else's photographs.
- Inheritance complications: one heir purporting to sell while other heirs' shares are concealed.

Verifying who you are dealing with
For an individual seller, the identity document must match the registered owner exactly, including the spelling of names. For a company, check the commercial register for its existence, who may represent it and whether insolvency or liquidation proceedings are recorded. For an agent, ask for the registration and a written contract. Where a power of attorney is used, verify its form, its scope and that it has not been revoked — this is the point at which the most serious losses occur.
Where to report
Suspected fraud is a criminal matter, reported to the Ministry of Interior structures or the prosecution service, while a parallel civil claim may be needed to protect rights in the property itself. Time is decisive: if a bank transfer was recent, notify your bank immediately, and if registration steps are under way, discuss protective measures with your lawyer at once. Preserve all correspondence, screenshots of the listing and payment records — none of it can be reconstructed afterwards.

Doesn't the notary protect me?
The notary performs the checks the law requires and is impartial. That is not the same as a party looking after the buyer's interest — a buyer's own lawyer fills that gap.
Can I get a deposit back?
It depends entirely on the preliminary contract. Where withdrawal, delay and refund conditions are not written down, recovery becomes markedly harder, which is why the text is reviewed before any money moves.
How do I spot a fake rental listing?
No cadastral identifier, refusal of an in-person viewing, a deposit demanded before any contract, and pressure to pay outside the banking system are the classic markers.
