Proving Bulgarian origin: the documents the law asks for

If you claim citizenship as a person of Bulgarian origin, the law expects official documents showing your kinship with an ancestor. Whether an old identity card is enough on its own is not answered by the law text, which names no document types; the authority handling the application decides what it accepts.

Descent and origin: two different doors

Under art. 8 of the Law on Bulgarian Citizenship (Закон за българското гражданство), anyone with at least one parent who is a Bulgarian citizen is a Bulgarian citizen by descent; art. 9 adds a person recognised by a Bulgarian citizen or whose descent is established by a court decision. If your grandparent was of Bulgarian origin but your parent is not a citizen, the route is naturalisation.

Art. 15 para. 1 says a person of Bulgarian origin may acquire citizenship by naturalisation without the general conditions of art. 12 para. 1 items 2, 4, 5 and 6. The same paragraph also lists a person fully adopted by a Bulgarian citizen and a person one of whose parents is, or died as, a Bulgarian citizen.

The document requirement

  • The application is filed with official documents, issued by Bulgarian or foreign authorities, showing kinship with at least one ascendant of Bulgarian origin up to the third degree inclusive (art. 15 para. 2).
  • The documents must contain the ascendant's names and the kinship to the applicant.
  • If these documents are not submitted, the proceedings are terminated (art. 29 para. 5).
  • The law does not list document types; whether an old identity card, a population record or another paper is enough is for the Ministry of Justice to assess.

Procedure and the Consultative Council

  1. Application

    It is filed in person with the Ministry of Justice (Министерство на правосъдието) or a Bulgarian diplomatic or consular mission; for young children (малолетни) a parent or guardian applies, and for older minors the parents or curators co-sign (art. 29).
  2. Interview

    An interview with the applicant is held when the documents are submitted; for minors it is held with the parents or guardians.
  3. Extra documents or review

    Where needed, the Minister of Justice may ask for additional documents within 14 days or refer the question of origin to the Consultative Council at the State Agency for Bulgarians Abroad (Консултативен съвет).
  4. Council opinion

    The Council gives a reasoned positive or negative opinion within two months of the referral. It looks at whether the applicant uses the Bulgarian language, self-identifies as being of Bulgarian origin, and whether at least one of these applies: being part of a Bulgarian community or minority in another country; coming from a place that was once part of the Bulgarian state or the Bulgarian Exarchate; having ascendants who carried the traditional Bulgarian family-name system (art. 29 para. 6).
