Legal status first: the Property Register

The Property Register (Имотен регистър), kept by the Registry Agency, records ownership and other rights in real property as well as encumbrances such as attachments (възбрани) and mortgages. According to the Agency's page the register is open to the public: certificates on entries, notations and deletions, and copies or extracts, can be requested in writing, at local registry offices or online against a fee and user registration. Whether the flat the seller calls "clean" carries any encumbrance is read from this record.

Then the cadastre: what exactly you are buying

The cadastre agency's KAIS portal (kais.cadastre.bg) offers electronic applications and documents based on cadastral data, such as sketches. These show whether the property data in the deed and on the cadastral map match. For the steps, see the article on cadastre look-ups.

Questions to answer yourself

  • How long and in which months will you use the home yourself? If you plan to let it for the rest of the time, that is a separate activity (see below).
  • Does the Property Register show an attachment, mortgage or other encumbrance?
  • Has the building obtained a permit for use? (See the article on the permit for use.)
  • Who sets the shared costs and the building maintenance fee, when and by what procedure? (See the article on condominium ownership.)
  • How is the property reached out of season, and who is responsible for heating and upkeep in winter?
  • Which tax rules apply to rental income and to gains on sale? That is the National Revenue Agency's (НАП) field; see the article on tax on rental income.

If you are thinking of short-term letting

The Ministry of Tourism's services page lists an application-declaration (заявление-декларация) for those who want to carry out accommodation activity in a guest room or guest apartment. The National Tourism Register shows accommodation places publicly. Whether a listing or a neighbouring flat appears there is the first place to see whether letting is regulated; confirm the rules for your own flat with the ministry and a lawyer.
