Maternity leave in Bulgaria: 410 days and after

Pregnancy and childbirth benefit in Bulgaria is paid for a period of up to 410 calendar days, of which 45 days fall before the birth. Two different things: LEAVE and BENEFIT

When people in Bulgaria say „maternity“, they are in fact referring to two distinct legal institutions with different foundations. The first is the LEAVE: it arises from the employment relationship, gives the right not to be at work, and is regulated in the Labour Code. The second is the BENEFIT: it comes from social insurance, replaces income, and rests on the Social Insurance Code. Someone entitled to the leave may have no entitlement to the benefit if they do not meet the insurance condition.

The distinction has direct practical value. „I have 410 days of leave“ is true; „money will come in for 410 days“ is true only where the insurance record condition is satisfied. For a woman who has just started work and is being insured in Bulgaria for the first time, the gap between those two sentences is literally the household budget. The question to ask on starting a job is therefore not „how many days of leave“ but „how many months of insurance record“.

410 days: how the calendar is built

According to the НОИ, mothers insured for general illness and maternity are entitled to pregnancy and childbirth benefit for a period of up to 410 days, of which 45 days are before the birth. The calendar therefore starts not at the date of birth but 45 days before it. The expected date of delivery is set by a doctor, and the start of leave is calculated against it.

A birth earlier or later than expected shifts the calendar but does not shorten the total. If the birth occurs before the 45 days have run, the unused days at the front are added after the birth; the full 410 days are preserved. That detail worries mothers with a premature delivery most of all, and the answer is in their favour.

The condition: 12 months of insurance record

According to the НОИ, persons insured for general illness and maternity are entitled to pregnancy and childbirth benefit instead of pay if they have 12 months of insurance record as insured for that risk. Note: those twelve months are not „time worked“ but INSURANCE record, and specifically under that risk. The record need not be continuous with one employer; separate periods are added together.

That six months suffices for sick pay while twelve are required here is no accident: this benefit is long and generous, so the entry threshold is higher. For a couple newly settled in Bulgaria the conclusion is plain — the plan for a pregnancy and the insurance calendar look at each other. Insurance periods in another EU state can count through the coordination rules, but only if documented and entered into the file.

Gather the documents when you learn of the pregnancy, not at the birth

Recording earlier EU insurance periods in your НОИ file takes time and requires correspondence between institutions. Families who start this after the birth begin receiving the benefit months later. The cheapest insurance is to start collecting the paperwork in the month you learn of the pregnancy.

The rate: 90% and a 24-month base

The daily pregnancy and childbirth benefit is set at 90%. The base is average daily gross labour remuneration, or average daily insurable income on which contributions have been paid or are due; for self-insured persons it is contributions actually paid. The period entering the calculation is the 24 calendar months preceding the month in which the leave begins.

That two-year window is the most overlooked detail of this benefit and it lands straight on the amount. For someone insured on a low income for two years the benefit comes out low; even if pay rose in the last six months, the wide window lifts the average only slowly. The reverse holds too: maternity following two years of high insurable income keeps the benefit high.

So that you can see the calculation yourself, the НОИ publishes an online calculator. Seeing the projected amount in advance lets you build the leave plan and the household budget on real numbers. That is also why no amount is written in this article: the figure is personal and only means something with your own insurable income.

The 1 July 2025 rule: work and the benefit stops

On its own page the НОИ flags an important change: as of 1 July 2025, pregnancy and childbirth benefit is NOT paid to persons engaged in a work activity that constitutes a ground for insurance for general illness and maternity. The rule applies to all cases, including benefits whose start date precedes it.

In practice that means the arrangement „I am on leave but working part-time and drawing both“ is no longer possible. It directly affects self-insured persons, those insured through their own company, and anyone planning project work while on leave. Anyone wanting income during leave must check IN ADVANCE whether that income falls within the insurance scope; a step taken without that check stops the benefit.

After the 410 days: leave until the child turns two

When the 410 days end the right does not disappear, it changes shape. In the НОИ's formulation, after the pregnancy and childbirth benefit period expires, during the additional paid leave for raising a young child the mother (or adoptive mother) receives a monthly benefit whose amount is set by the State Social Insurance Budget Act. That leave runs until the child turns two.

The difference between the two periods is not only length but logic. In the first, the benefit is PERSONAL — 90% of your own insurable income. In the second, it is THE SAME FOR EVERYONE — a fixed monthly sum set by statute. Household income therefore drops noticeably after day 410, and the drop is sharper in higher-earning households. Planning should be anchored not to the birth date but to day 410.

Another feature of this leave is that it is transferable: the mother may stop using it and the leave may be taken over by the child's father or by one of the relatives the law lists. The transfer carries both the leave and the benefit, letting families reshape the return-to-work plan. Why no amounts are written here

This article states no MONETARY AMOUNTS for either the 410-day period or the care period up to two years — only percentages and durations. The reason fits in one sentence: the first period's amount varies with the person's own 24-month insurable income, and the second period's amount is set anew each year by the budget act. Writing a figure without a clear year causes bad planning at exactly the moment of need.

The right move is two steps: for the first period, run the НОИ calculator on your own data; for the second, read the monthly amount set by the budget act in force on the НОИ care-benefit page. Add them together and you see your income curve for the next two years in real numbers — more useful than any plan built on assumptions.

Working conditions during pregnancy

The months before leave begins are not legally empty either. Bulgarian labour law grants pregnant workers a set of specific protections, at the centre of which sits adaptation of the work: employment on work classified as harmful or risky is prohibited; pregnant workers are a protected group as regards night work and overtime; and where necessary, on the basis of a medical opinion, a change of duties or working conditions is arranged.

For those protections to operate there is one condition: the situation must have been NOTIFIED to the employer. Where a pregnancy is undisclosed, the employer defends itself by not having known, and the protection does not in fact operate. Notification is made in writing and supported by a medical document; it is a disclosure of personal health information and should be made only to the extent needed — but without it the protection does not arise.

How pay is set on adapted duties is a separate calculation, and where a loss of income arises there is a distinct benefit item on the social insurance side. It differs from the pregnancy and childbirth benefit and applies during the pregnancy, that is, before leave begins. The calendar: from pregnancy to return

  1. When you learn of the pregnancy, measure your insurance record

    Do you have 12 months insured for general illness and maternity? If not, work out when they will be complete; that date frames your plan.
  2. Document your earlier EU insurance periods

    Aggregation depends on documents, and inter-institution correspondence takes time. Start early.
  3. Settle the expected date and the start of leave with your doctor

    The 45-day pre-birth period is calculated against that date. If the date changes, the start of leave changes with it.

    Know in advance what the 24-month window yields in your case. The budget plan is built from there.
  5. Put day 410 and the second birthday in your calendar

    Income falls at the transition between the two periods; at the end of the second comes the childcare decision. Both are planned ahead.
  6. Correspond with your employer before the return date

    Return conditions, working hours and any adaptations should be in writing. A verbal understanding is worth nothing on the day you return.

Your employment during the leave

Maternity leave does not end the employment contract; the relationship continues and annual leave keeps accruing. A returning worker is also protected by the two-year limitation rule: the two-year period restarts from the end of the year in which the reason for non-use ceased. Accumulated days belonging to someone returning from a long maternity leave therefore do not burn the following year.

The most common problem on return is a changed position. Bulgarian labour law gives workers additional protection in pregnancy and maternity, and that protection extends to dismissal. Against that, remember that during a probation period those protections are not open; where a probation period coincides with a pregnancy, it is wise to ask for written information and consult the Labour Inspectorate before deciding anything.

The father and other relatives

Birth in Bulgaria is not an event concerning only the mother: the father has his own leave at the birth, the leave may be transferred from mother to father, and there is a separate right to leave to raise a child until the age of eight. The only warning here concerns planning: the rights do not replace one another, but some are deducted from others. Leave taken in place of the mother, for instance, may be set off against the father's own entitlement. The decision of „who is on leave when“ should therefore be taken against the whole picture, not right by right.

The mechanics of payment: documents, account, delay

Maternity benefit, like sickness benefit, is transferred by the НОИ straight to the worker's bank account and does not pass through payroll. The chain works on the same logic: leave begins, the employer files the data the institute requires, the institute receives it, and the payment clock starts from then. The commonest cause of delay is therefore not the institute's speed but a stall somewhere along the filing chain.

So when a first payment is missing, ask in order: has the employer recorded the leave, has the data been filed, does the insurance record reach twelve months, are the bank details current. Before all four are verified, „the НОИ is not paying“ is a premature diagnosis. Over a long leave the payments then come at a monthly rhythm; a delayed first payment can shift the later ones, which is why tracking in the first month matters most.

One final practical point: if your address, bank account or contact details change during the leave, update them with the institute. Over a period approaching two years such changes are normal, and an out-of-date account quietly leaves the payment in limbo — nobody will phone to warn you.

Notes for foreign workers

For an EU citizen insured in Bulgaria the system works exactly as it does for Bulgarian nationals; the only difference lies in documenting the insurance record. For non-EU nationals there is an extra layer: where the residence and work permit is grounded in the employment relationship, how that ground continues through the leave must be clarified in advance. That question belongs to the migration authorities, not to the НОИ.

Among families moving between Türkiye and Bulgaria, the commonest mistake is assuming the two countries' entitlements can be added together. The relationship between the two systems rests on a separate legal footing; the country in which you are insured determines from whom the benefit is claimed. Clarify this in writing during the pregnancy.

After the two years: nursery, flexible work, return

When the child turns two the care leave ends and the family faces three options: returning full-time, moving to part-time, or extending with unpaid leave. All three are lawful, and all three have different consequences — part-time work reduces pay in proportion, while unpaid leave stops income entirely and carries its own rules on insurance.

Nursery or kindergarten enrolment is the most practical leg of that decision, and municipal application timetables in most cities run long before the child turns two. The „we have two years, we will see“ approach ends in missing the allocation. The commonest mistakes

  • Treating leave and benefit as the same — the right to 410 days of leave exists, but the benefit depends on 12 months of insurance record.
  • Ignoring the 24-month base — the benefit is calculated on the average of the 24 months before the leave; high pay in the final months alone is not enough.
  • Forgetting day 410 — in the second period the benefit stops being personal and becomes a fixed monthly sum; the income drop must be anticipated.
  • Doing insured work while on leave — as of 1 July 2025 that results in the benefit not being paid.
  • Collecting documents late — recording earlier EU periods takes time; correspondence started after the birth delays the benefit.
